Chapter 13 Bankruptcy Forms
Filing for bankruptcy under Chapter 13 demands a debtor to file the various documents defined under numerous Schedules to the federal bankruptcy court along with the filing fee and the administrative fee. Failure to submit the desired documents and the stipulated filing and administrative fees will result in the rejection of the petition. The documents and the forms to be submitted vary with the area of domicile of the petitioner. The debtor has to ensure that the forms filled by him is relevant to the current year and take into account the various amendments made to these forms. The month and year of the forms are earmarked on the upper right corner of these forms.
All the required forms and schedules are to be filed before the Court no later than 14 calendar days after filing the voluntary petition. The major documents involved in the Chapter 13 bankruptcy filing are Schedule A providing information on real estate, Schedule B on personal property, Schedule C containing information on the property claimed exempt (new form effective 4/1/10), Schedule D explaining the creditors holding secured claims, Schedule E consisting of details of unsecured creditors holding priority claims (latest form effective 4/1/10), Schedule F with the details of unsecured creditors with non-priority claims, Schedule G explaining the executory contracts and unexpired lease details, Schedule H containing details of co-debtors, Schedule I on current income and the Schedule J explaining in detail current expenditures of the debtor. Debtor’s Certification of Employment Income, Chapter 13 Plan, Declaration concerning debtor’s Schedules, Individual Debtor’s Statement of Compliance with Credit Counseling Requirement under Exhibit D, Voluntary Petition under Exhibit C, are the other documents to be filed under Chapter 13. Over and above these documents, the debtor is to submit Statement of Current Monthly Income and Calculation of Commitment Period and Disposable Income (Form 22 C), Statement of Financial Affairs (Form 7), and Statement of Social Security Number or other Taxpayer Identification Number to aid in the verification of the details on the last tax payments made by the debtor.
The documents have to be submitted in the Order defined by the local court in original as well as duplicate.
